| Access to all mediations is User ID and Password protected. User
IDs and Passwords are assigned by the Butler Online Registrar upon
receipt via U.S. Mail or facsimile of a User Registration Form,
which includes the attorney's state bar number and unique personal
information. No one can gain access to the Butler Online
Mediation system (beyond the introductory pages) without the User ID
and Password. |
| In addition, to have access to a particular mediation, a lawyer
must register as the attorney for a party to the mediation of a
particular case to be able to have access and participate in it.
This means that unless a person is both a registered user and has
registered in writing as the attorney for a party to a particular
mediation, he or she will not have access to an Online Mediation.

Confidential
Negotiations
All negotiations are conducted between
each individual claimant and each individual defendant in a secure
Private Exchange. The Private Exchange is similar to a private
caucus or private session in a traditional mediation. Negotiations
in the Private Exchange are confidential. Only the lawyer registered
as representing the particular defendant and the lawyer for the
particular claimant have access to the Private Exchange between that
claimant and defendant. This means that no defendant or its attorney
has access to the Private Exchanges of any other defendant. (The
only exception is where the same lawyer represents more than one
defendant in the lawsuit.) This is also true of all reports that can
be requested from the Butler Online system. You will have access
only to reports of mediations involving your clients. Only you and
the lawyer for the opposing party in the mediations will have access
to reports about those mediations. |
| This confidentiality extends to attorneys for claimants. No
Claimant's (Plaintiff's) Attorney will have access to the mediations
of any other Claimant's Attorney. |
